Early commitments help patent pool formation

چکیده

This paper explores in what circumstances patent owners can be expected to join unilaterally a patent pool. We develop a simple model in which owners of patents reading on a standard grant licences to competing manufacturers. Manufacturers must sink a …xed cost to enter the market for standard compliant products, and are thus exposed to a hold up when royalties are set after their entry. We show that the formation of non-cooperative patent pools nearly always fails if it takes place once manufacturers have incurred …xed costs as is usually the case. By contrast, allowing the formation of patent pools ex ante facilitates the emergence of stable non-cooperative patent pools. Such ex ante pools yield lower prices and higher licensing pro…ts than ex post patent pools would. We discuss the policy implications of these results concerning the credibilty of licensing commitments required by standard setting bodies. Patent pool formation: Timing matters

This paper addresses the problem of non-cooperative patent pool formation by owners of patents related to a standard. We develop a model in which competing manufacturers must license several patents to produce standard-compliant goods. Separate licensing creates a double-marginalization problem. Moreover manufacturers must sink a fixed cost to enter the product market, and thus face a hold-up p...

Ex-ante Agreements in Standard Setting and Patent Pool Formation

We present a model of standard setting and patent pool formation. We study the effects of alternative standard-setting and pool-formation rules on technology choice, prices and welfare. We find three main results. First, we show that allowing patent pools may reduce welfare when standards are negotiated and patent pools need to be ex-post incentive compatible. Second, we show that it is not pos...

The problem of patent thickets in convergent technologies.

Patent thickets are unintentionally dense webs of overlapping intellectual property rights owned by different companies that can retard progress. This article begins with a review of existing research on patent thickets, focusing in particular on the problem of patent thickets in nanotechnology, or nanothickets. After presenting visual evidence of the presence of nanothickets using a network an...

Title Differentiated Standards and Patent Pools

We consider patent pool formation by owners of essential patents for differentiated standards that may be complements or substitutes in use. Pooling improves coordination in terms of royalty setting within a standard but provokes a strategic response from licensors in the competing standard. We characterise the incentives to form and defect from pools within standards and show how pool formatio...

Are patent pools a way to help patent owners enforce their rights ? 1

This paper explores empirically the interplay between patent pooling and litigations using data on 1,564 United States patents belonging to eight different pools and to a control database with patents having the same characteristics. We investigate two main questions. We first assess whether the entry in a pool fosters the patents’ enforcement. Our analysis makes it possible to highlight variou...
